Terms of Service

These Terms of Service ("Terms") constitute a binding legal agreement between you and bitPUNCH e.K., Dominic Rodemer ("Company", "we", "us", or "our"), located at Saroltastraße 28, 64407 Fränkisch-Crumbach, Germany. By downloading, accessing, or using the PDF Pro application ("App") on iOS, macOS, or Windows, you agree to be bound by these Terms.

You may access and use parts of PDF Pro for free; however, access to Premium Features (such as advanced PDF editing, signing, and annotation capabilities) requires payment of subscription fees.

1. Service Description and Usage

PDF Pro is a utility application designed to help users view, edit, and manage PDF documents. While we strive to provide a high-quality service, the App is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time.

2. Subscriptions, Pricing, and Payments

We offer various subscription plans that grant access to PDF Pro Premium Features. The specific pricing terms, currency, and billing entity applicable to you depend on the platform (Operating System) you are using.

A. iOS and macOS Users

Payment Processing: For users on iOS and macOS, all billing and payments are processed exclusively by Apple. We do not store or have access to your credit card information. Payments will be charged to your Apple ID account at the confirmation of purchase.

Automatic Renewal: Your subscription will automatically renew for the same duration as your original plan unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

B. Windows Users

Merchant of Record: Our order process for the Windows version is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our Windows orders.

Payment Processing: Billing for Windows subscriptions is handled securely by Paddle. You agree to their terms of service when completing a purchase. We do not store your financial data.

Automatic Renewal: Windows subscriptions automatically renew at the end of each billing cycle. You will be charged the standard rate for your chosen plan unless you cancel before the renewal date.

3. Cancellation and Refund Policy

A. iOS and macOS

Cancellation: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings after purchase. To cancel, navigate to Settings > [Your Name] > Subscriptions on your iOS device or Mac.

Refunds: Since all payments are handled by Apple, your purchase is subject to Apple’s applicable payment policy. If you require a refund, you must contact Apple directly at https://reportaproblem.apple.com or use the link provided at the bottom of the subscription screen in the App.

B. Windows

Cancellation: You may cancel your Windows subscription at any time. Instructions for cancellation are provided in the email receipt sent by Paddle upon purchase, or you can contact our support team for assistance.

Consumer Right to Cancel and Refunds: If you are a consumer, you have the right to cancel your purchase within 14 days from the day after completion of the transaction without giving any reason. To exercise this right, you must inform Paddle of your decision before the 14-day period expires by contacting them at paddle.net. Please note that this right to cancel applies only to the initial subscription purchase, not to automatic renewals.

Exception: Your right to cancel does not apply to digital content that you have already started to download or use, or to products from which you have already benefited.

Effect of Cancellation: If you cancel within the 14-day period and qualify for a refund, Paddle will reimburse all payments received from you without undue delay, and no later than 14 days after being informed of your cancellation. The reimbursement will be made using the same payment method you used for the original transaction.

Refunds Outside the Cancellation Period: Refunds requested after the 14-day cancellation period are provided at Paddle's sole discretion on a case-by-case basis and may be refused. This does not affect your statutory rights as a consumer in relation to products which are not as described, faulty, or not fit for purpose.

4. Intellectual Property Rights

App Ownership: The PDF Pro App, including its source code, design, interface, and proprietary content, is owned by bitPUNCH e.K. and is protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal or professional purposes.

User Content: We claim no ownership over the documents you edit or view using PDF Pro. Your data remains yours.

5. Privacy Policy

Your privacy is important to us. We do not collect personal usage data or analyze the content of your documents.

Subscription Data:

  • Apple Users: Subscription status and payment data are handled entirely by Apple.
  • Windows Users: Transaction data (such as your email address and license validity) is processed by Paddle to fulfill your order and tax obligations.

For a detailed explanation of how data is handled, please review our full Privacy Policy at https://www.pdf-pro.net/privacy-policy/.

6. Pricing Change Policy

Our prices may change in the future. If the pricing for your subscription changes, we (or our billing partners Apple/Paddle) will notify you in advance and provide you an opportunity to cancel your subscription before the new price is applied to an automatic renewal.

7. Disclaimers and Limitation of Liability

To the fullest extent permitted by applicable law, bitPUNCH e.K. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; or (b) any conduct or content of any third party on the App.

We do not guarantee that the App will function error-free or uninterrupted. You are responsible for backing up your own documents.

8. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date of the Terms within the App or via the App Store/Website description. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
